2. Scope of Service

Bold Knight offers communication automation solutions and intelligent agents that enable companies to manage interactions with their customers across different channels, including WhatsApp Business.

Our platform acts as an intermediary between your company, Meta Platforms, Inc., and the end users who communicate with you.

3. Registration and Use

To access the services you must have a valid WhatsApp Business account and grant the necessary permissions through Meta's OAuth flow. You are responsible for the accuracy of the data provided during setup. Use of the service is limited to legitimate purposes related to business communication.

The following are prohibited:

• Using the services for spam, fraud, illegal activities, or unauthorized mass messaging.
• Collecting or processing user data without valid consent.
• Attempting to compromise security, decompile, or manipulate the platform.

4. Data Processed

By connecting your account with Bold Knight, data such as the following will be processed:

• Phone numbers, names, and email addresses of contacts.
• Incoming and outgoing WhatsApp messages.
• Conversation identifiers and messaging metadata.

Bold Knight is not responsible for the content of messages that your company exchanges with its contacts. You are the legal controller of your customers' data.

5. Integration with Meta Platforms

The service uses the WhatsApp Business API and therefore:

• Certain data is shared with Meta Platforms to enable messaging.
• Your use of Bold Knight is also subject to WhatsApp Business Terms and Meta Developer Policies.

6. Responsibilities

Bold Knight's: ensure reasonable service continuity, implement security measures, and process data in accordance with the law.

Client's: ensure lawful use, obtain the necessary consents from their end users, and avoid misuse.

Bold Knight shall not be liable for service interruptions caused by third parties (Meta, hosting providers, etc.), nor for any misuse a client makes of their contacts' data.

7. Intellectual Property

All software, designs, algorithms, and documentation associated with Bold Knight are the exclusive property of Bold Knight SpA.

The client retains ownership of their data and content, but grants Bold Knight a limited license to process it solely for the purpose of providing the contracted service.

8. Data Retention and Deletion

• Data is retained for the duration of the commercial relationship.
• Once the relationship ends, data will be deleted or anonymized, unless there is a legal obligation to retain it.
• End users may request data deletion through the procedure described in our Privacy Policy.

9. Limitation of Liability

The service is provided "as is" and without absolute guarantees of availability.

In no event shall Bold Knight be liable for indirect damages, data loss, loss of revenue, or reputational harm arising from use of the service.

10. Modifications

We may update these Terms at any time. We will notify clients by email or through a notice on the platform. Continued use of the services after an update constitutes acceptance of the new terms.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Chile.

Any dispute will be resolved in the competent courts of Santiago, Chile.

12. Compliance with Meta Policies

Our application complies with Meta's Developer Terms and the WhatsApp Business Platform privacy policies. All information collected is processed in accordance with applicable data protection legislation and is limited exclusively to what is necessary to enable the integrations approved by Meta.
